Terms of Service – Bagisto.pl

§1General Provisions

1. These Terms of Service govern the use of the Bagisto.pl e-commerce platform, provided by:

2. Bagisto.pl is a SaaS (Software as a Service) platform enabling the creation and operation of online stores based on the Bagisto software.

3. Using the platform constitutes acceptance of these Terms of Service.

§2Definitions

• Service Provider – Sprzedaje.tv sp. z o.o.,
• User – a natural or legal person who has registered an account on the Bagisto.pl platform,
• Platform – the Bagisto.pl system made available by the Service Provider,
• Store – an individual online store instance created by the User on the platform,
• Store Customer – a person making purchases in a Store operated by the User,
• Agreement – the SaaS service agreement concluded between the Service Provider and the User,
• Plan – the service package selected by the User, defining the scope of features and limits.

§3Registration and Account

1. Registration on the platform is free of charge and available to adults and business entities.

2. During registration, the User provides: their full name or company name, e-mail address and password.

3. The User is obliged to provide accurate data and to update it in the event of any change.

4. The account is non-transferable and may not be shared with third parties.

5. The Service Provider reserves the right to delete any account that violates these Terms of Service.

§4Scope of Services

1. Within the Bagisto.pl platform, the Service Provider offers the following services:

• Access to the online store software (Bagisto),
• Store hosting on the Service Provider’s servers,
• Automatic domain configuration and SSL certificate,
• Access to the store admin panel,
• Technical support in accordance with the selected plan,
• Regular updates and backups,
• Access to integrations (payments, shipping, accounting, KSeF).

2. The detailed scope of services and limits are defined by the selected pricing Plan available at Bagisto.pl/pricing.

§5Fees and Billing

1. The Bagisto.pl platform offers a free trial period in accordance with the current offer.

2. After the trial period, continued use of the platform requires purchasing a paid Plan.

3. Fees are charged in advance for the selected billing period (monthly or annually).

4. The Service Provider issues VAT invoices based on the data provided during registration.

5. Failure to pay on time results in suspension of the service. Store data is retained for 30 days from the date of suspension.

6. The Service Provider reserves the right to change the pricing with 30 days’ notice.

§6User Obligations

1. The User agrees to:

• Use the platform in compliance with Polish and EU law,
• Refrain from publishing illegal content, content infringing third-party rights, or content contrary to public morality,
• Independently fulfil all legal obligations related to operating a store (business registration, tax settlements, GDPR),
• Refrain from compromising the security of the platform or other users,
• Maintain the confidentiality of account credentials.

2. As the store owner, the User is responsible for:

• Content published in the store,
• Order fulfilment and customer service,
• Compliance with personal data protection regulations (GDPR) in relation to store customers,
• Maintaining their own privacy policy and store terms and conditions.

§7Service Provider’s Liability

1. The Service Provider will endeavour to keep the platform available 24/7 but does not guarantee uninterrupted service.

2. The Service Provider shall not be liable for:

• Content published by Users in their stores,
• Transactions concluded between Users and their customers,
• Interruptions resulting from maintenance work or failures beyond the Service Provider’s control,
• Data loss caused by the User’s own actions,
• Consequences of the User’s breach of these Terms of Service.

3. The Service Provider’s liability is limited to the amount of fees paid by the User in the last billing month.

§8Intellectual Property

1. The Bagisto.pl platform is based on the Bagisto software (MIT open source licence) and the Service Provider’s own proprietary modules.

2. The User retains full rights to the content published in their store.

3. The name, logo and trademarks of Bagisto.pl are the property of Sprzedaje.tv sp. z o.o. and may not be used without the Service Provider’s consent.

§9Termination of Agreement

1. The User may terminate the agreement at any time by deleting their account in the admin panel or by contacting us at biuro@sprzedaje.tv.

2. Following termination, store data is retained for 30 days and then permanently deleted.

3. The Service Provider may terminate the agreement with immediate effect in the event of a material breach of these Terms of Service.

4. In the event of termination due to the Service Provider’s fault, the User is entitled to a refund of fees paid for the unused billing period.

§10Personal Data Protection

The rules for processing personal data are set out in the Bagisto.pl Privacy Policy, which forms an integral part of these Terms of Service.

§11Complaints

1. Complaints regarding the platform should be submitted to biuro@sprzedaje.tv.

2. A complaint should include: the User’s details, a description of the issue and the date it occurred.

3. The Service Provider will handle complaints within 14 business days.

§12Final Provisions

1. Matters not covered by these Terms of Service shall be governed by Polish law, in particular the Civil Code and the Act on the Provision of Electronic Services.

2. Any disputes arising from the Agreement shall be resolved by the court with jurisdiction over the Service Provider’s registered office.

3. The Service Provider reserves the right to amend these Terms of Service with 14 days’ notice. Users will be informed of any changes by e-mail.
